Terms of Use

The following terms and conditions govern your use of this website along with all data and information you obtain from the same, including pursuant to the downloadable SaaS Metrics Template and analysis made available herein (together with the website, the “Oxx GTMF Toolkit”).

 
The Oxx GTMF Toolkit is made available “as is” and neither Oxx Ltd nor any of its affiliated companies, associates, officers, employees, agents or suppliers (together, the “Company”) make any express or implied representation or warranty of any kind as to the contents of the Oxx GTMF Toolkit, including to merchantability, non-infringement, title, or fitness for a particular purpose or use, whether arising by statute or otherwise in law including from a course of dealing or usage.

Use of the Oxx GTMF Toolkit is at user’s sole risk, and the Company accepts no responsibility or liability with respect to the adequacy, accuracy, completeness, reasonableness or likelihood of any analysis contained in the Oxx GTMF Toolkit. The Company expressly disclaims any obligation or undertaking to disseminate any updates or revisions to the information contained herein. Any users or recipients of the Oxx GTMF Toolkit, who choose to review and consider its contents, must take their own independent advice, and accept that the Oxx GTMF Toolkit cannot in any way serve as a substitute for inquiries and procedures which they will or should be undertaking for the purposes of satisfying themselves regarding any matters of interest to them and will not use or rely upon the Oxx GTMF Toolkit to form the basis of any decisions, investment or otherwise.

The Oxx GTMF Toolkit including all of its content is made available to users pursuant to a royalty-free, non-exclusive licence from the Company and its licensors. This licence is a personal licence to users to use the Oxx GTMF Toolkit for their own use, but expressly does not extend to allowing users to re-use or re-package the content of the Oxx GTMF Toolkit in order to create a website or other content which is similar to or competes with the Oxx GTMF Toolkit and its intended use.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE TO USERS (OR TO ANY PERSON CLAIMING RIGHTS DERIVED FROM THE USER’S RIGHTS) FOR ANY DAMAGES OF ANY KIND, WHETHER IN CONTRACT, TORT OR OTHERWISE AS MAY ARISE FROM THE USE OF THE OXX GTMF TOOLKIT.

These terms and conditions are governed by English law, and any claims relating to them and the Oxx GTMF Toolkit shall be subject to the exclusive jurisdiction of the courts of England and Wales.
